Who You Know — Terms and Conditions
Last updated: 1 October 2026 · Effective from: 1 October 2026
Key terms at a glance
This summary is here to make the main points easy to find. The full Terms below apply.
- What we sell: access to one-on-one intro calls with verified employees at companies you're interested in. We don't sell referrals, jobs or interviews, and we don't guarantee any of them.
- We are not a recruitment agency and we don't find you a job. Referrers are independent people, not our staff.
- Plans start the day you pay. From then you can browse openings, see your matches and send requests.
- Job seeker plans renew automatically until you cancel. You can cancel at any time in your account, and you keep access until the end of the period you've paid for.
- Requests: every plan includes 5 requests per month. If a request doesn't lead to a call because the referrer declines, no call is booked within 15 business days, or the referrer doesn't turn up, we return it to your balance.
- If you miss a booked call, that request is used up.
- Your rights under the Australian Consumer Law aren't affected by anything in these Terms.
- Insiders (referrers): listing is free for founding insiders who create their account by 31 October 2026. Insiders who join from 1 November 2026 pay $1.99 a month to list. Every insider saves a card when they list, which is charged a $20 no-show fee only if our team confirms they missed a booked call without rescheduling. Every insider must follow their employer's policies and must never take money from job seekers.
Part A — General terms (everyone)
1. About these Terms
1.1 These Terms are an agreement between you and the owner of the registered Australian business name Who You Know ("we", "us", "our"). Our full business details are available on request by emailing support@whoyouknow.au. They cover your use of the website and app at whoyouknow.au (the "Platform").
1.2 By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy.
1.3 You must be at least 18 years old and able to enter into a binding contract.
1.4 Part B also applies if you use the Platform as a job seeker. Part C also applies if you use it as a referrer.
2. What Who You Know is, and what it isn't
2.1 Who You Know is an online platform where job seekers ("Seekers") can request a one-on-one intro call with verified employees ("Referrers") at companies they're interested in, so they can learn about the company, team and role from someone who works there.
2.2 We are not an employment placement service, recruitment agency or employer. We don't find, offer or promise employment. We don't act for any employer, and we don't take part in any hiring decision.
2.3 Referrers are independent users. They are not our employees, agents or contractors. Anything a Referrer says or does, including whether they choose to refer a Seeker through their employer's referral program, is their own decision and happens between them and their employer.
2.4 We don't guarantee that a call will lead to a referral, interview, job offer or any other outcome.
3. Your account
3.1 You must give us accurate, current information, including your real name and your own LinkedIn profile link, and keep it up to date.
3.2 You may have only one account. Keep your login details secure and tell us promptly at support@whoyouknow.au if you think someone else has used your account.
3.3 You are responsible for what happens on your account, unless it's caused by our failure to take reasonable care.
4. Acceptable use
You must not:
- pretend to be someone else, or misrepresent your employer, role, experience or qualifications
- upload anything false, misleading, defamatory, or that you don't have the right to share
- harass, threaten, discriminate against, or behave inappropriately towards anyone you meet through the Platform
- ask for or offer any payment, gift or benefit between Seekers and Referrers, including in exchange for a referral
- use the Platform to contact people for purposes unrelated to the intro call, such as sales or marketing
- record a call without the clear consent of everyone on it (recording a private conversation without consent can be an offence in NSW and other states)
- share information that's confidential to a Referrer's employer
- copy, scrape or collect data from the Platform, or try to get around our security or the limits on requests and spots
- use the Platform for anything unlawful
5. Content you provide
5.1 You keep ownership of what you upload or write, such as your CV, profile and messages ("Your Content").
5.2 You give us a non-exclusive, royalty-free licence to store, copy, display and share Your Content only as needed to run the Platform. For example, we show a Seeker's CV and answers to the Referrers they send requests to. This licence ends when you delete Your Content or your account, except for copies we need to keep by law or for records of past transactions.
5.3 You confirm you have the right to share Your Content and that it doesn't break anyone else's rights or the law.
6. Privacy
6.1 Our Privacy Policy explains how we collect, use, store and share personal information, in line with the Australian Privacy Principles.
6.2 In short: a Seeker's profile, CV and request answers are shared only with the Referrers they send requests to (and with our team and any assigned concierge). A Referrer's name, photo and LinkedIn are shown to a Seeker only after the Referrer accepts that Seeker's request.
6.3 We send service emails about your account, requests, calls and payments. We send marketing emails only with your consent, and you can unsubscribe at any time.
7. Calls
7.1 Calls are booked through the Referrer's scheduling link (currently Calendly) and hosted on whatever tool the Referrer's booking is set up with (for example Zoom, Google Meet or phone).
7.2 A call must be booked within 15 business days (Monday to Friday, excluding NSW public holidays, Sydney time) of the Seeker sending the request.
7.3 Either person can reschedule up to 24 hours before the call, as long as the new time is still within the 15 business day window. Within 24 hours of the call, the time is locked.
7.4 After each call, we ask both people whether the call happened. If the answers conflict, our team reviews it and decides the outcome fairly, based on the information both people give us.
7.5 Be on time, be respectful, and let the other person know as early as possible if you need to reschedule.
8. Third-party services
8.1 We use third-party services to run the Platform, including Pinch Payments (payments), Calendly (booking) and Base44 (hosting and infrastructure). Video or phone calls run on the Referrer's chosen tool.
8.2 Your use of those services may also be subject to their own terms. We're not responsible for them, except where we've failed to take reasonable care in choosing or using them.
9. Your rights under the Australian Consumer Law
9.1 Our services come with guarantees that can't be excluded under the Australian Consumer Law, including that they will be provided with due care and skill and within a reasonable time. If we fail to meet a consumer guarantee, you may be entitled to a remedy, which can include a refund.
9.2 Nothing in these Terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded. The returned-request arrangement in Part B is in addition to those rights, not instead of them.
10. Liability
10.1 Subject to clause 9, we're not responsible for:
- the conduct, statements or decisions of Referrers, Seekers or employers
- whether a call leads to a referral, interview or job
- the accuracy of information that users provide
- loss caused by third-party services outside our reasonable control
10.2 Subject to clause 9, and to the extent the law allows, we're not liable for indirect or consequential loss, and our total liability to you for any claim about the Platform is limited to the amount you paid us in the 12 months before the claim arose.
10.3 This clause doesn't limit our liability for death or personal injury caused by our negligence, fraud, or anything else that can't legally be limited.
11. Indemnity
You agree to cover reasonable losses we suffer because you seriously or deliberately break these Terms or the law, for example by misrepresenting your identity or sharing your employer's confidential information. This is reduced to the extent that we caused or contributed to the loss.
12. Suspension and closing accounts
12.1 You can close your account at any time from your account settings or by emailing support@whoyouknow.au. Cancelling a plan is covered in clause 15.
12.2 We may suspend or close your account if:
- you seriously or repeatedly break these Terms
- we reasonably believe you've provided false identity or employment information
- we need to, to protect other users or comply with the law
Where it's reasonable and safe to do so, we'll tell you why and give you a chance to respond first.
12.3 If we close your account for a reason other than your breach of these Terms, or if we stop running the Platform, we'll refund the unused part of any plan you've paid for in advance.
13. Changes
13.1 We may improve or change the Platform over time. We won't make a change that materially reduces what you've already paid for during your current billing period.
13.2 We may update these Terms. For material changes, we'll give you at least 14 days' notice by email. If you don't agree, you can cancel before the change takes effect and we'll refund the unused part of any plan you've paid for in advance.
14. Complaints, disputes and general
14.1 Complaints: email support@whoyouknow.au. We'll acknowledge your complaint within 2 business days and aim to resolve it within 14 days. If you're not satisfied, you can contact NSW Fair Trading or your local consumer protection agency.
14.2 Governing law: these Terms are governed by the laws of New South Wales, Australia. Each party can bring proceedings in the courts of New South Wales, and this doesn't limit any consumer's right to go to a tribunal or court with jurisdiction where they live.
14.3 General: if any part of these Terms is found to be invalid or unenforceable, the rest still applies. If we don't enforce a right straight away, we haven't given it up. These Terms, the Privacy Policy and any offer details shown at checkout make up the whole agreement between us about the Platform. We may send notices to the email address on your account.
Part B — Job seekers
15. Plans, payment and cancelling
15.1 Plans. The current plans and prices are shown on our pricing page and at checkout. All prices are in Australian dollars. We're not registered for GST, so no GST is charged. If that changes, we'll tell you before it affects your price.
| Plan | Price | Billing |
|---|---|---|
| Monthly | $19.99 | every month |
| 4 months | $63.99 | every 4 months |
| 1 year | $169.99 | every 12 months |
15.2 Launch prices. The prices above are launch prices available to new members until 31 October 2026. After that date, new members pay $29.99 / $95.99 / $249.99. If you join at a launch price, you keep that price for as long as your plan stays active without a break. If you cancel and join again later, the prices at that time apply.
15.2A When your plan starts. Your plan starts, and you can send requests, on the day you pay. Anyone can browse openings without a plan.
15.3 Automatic renewal. Your plan renews automatically at the end of each billing period, and we charge the card you gave us through Pinch Payments until you cancel. When you pay, you authorise us to store your card with Pinch Payments for these renewals. For 4-month and 1-year plans, we email you at least 7 days before renewal.
15.4 Cancelling. You can cancel at any time in your account settings. You keep access, including any requests left for the current month, until the end of the period you've paid for, and you won't be charged again.
15.5 Failed payments. If a renewal payment fails, we'll let you know. You won't be able to send new requests until the payment succeeds, but any calls already accepted or booked will continue.
15.6 Price changes for existing plans. We'll give you at least 30 days' notice before changing the price of your plan. If you don't agree, you can cancel before the new price applies.
16. Requests
16.1 Monthly requests. Every plan includes 5 requests per month. Your balance resets to 5 at the start of each billing month. Unused monthly requests don't carry over.
16.2 Extra requests. You can buy a pack of 5 extra requests. Until 31 October 2026 a pack costs $19.99. From 1 November 2026 it costs $19.99 for founding members (members whose current plan was bought at a launch price, for as long as that plan stays active without a break) and $29.99 for everyone else. Pack requests don't expire while your account is open, and are used after your monthly requests run out.
16.3 Using a request. A request is used when you send it to a Referrer's opening. Hidden (unadvertised) roles use one request, like any other opening.
16.4 Returned requests. We return the request to your balance if:
- the Referrer declines it
- no call is booked within 15 business days of sending it, or
- our team confirms the Referrer didn't show up to a booked call.
A returned request is always restored, even if it comes back after your monthly reset. You can use it with any other Referrer.
16.5 If you miss the call. If you don't show up to a booked call, or you cancel within 24 hours of it, that request is used up and isn't returned.
16.6 Clause 16 doesn't limit your rights under clause 9 (Australian Consumer Law).
17. Intro call guarantee (4-month and 1-year plans)
17.1 If you're on a 4-month or 1-year plan and you don't have an intro call during your plan term, we won't charge you to renew. Instead your plan continues free, one month at a time, with 5 requests per month, until you have your first intro call.
17.2 You "have an intro call" when a call is confirmed as completed, or when you don't show up to a booked call (clause 16.5).
17.3 Once you've had your intro call during a free month, the free period ends at the end of that month. Your plan then renews at its normal price unless you cancel. We'll email you before any charge.
18. Concierge
18.1 What's included. Concierge costs $499, paid once. It includes a 5-week program (a kick-off call, a CV and LinkedIn rewrite, a professional headshot session in Sydney, 5 weekly check-ins, and our team arranging 3 intro calls with insiders at your target companies), plus 12 months of platform access with 5 requests per month. The 3 arranged calls don't use your monthly requests. Your 12 months of platform access start on the day you pay. The 5-week program starts on 1 November 2026, and we'll contact you before then to book your kick-off call.
18.2 Our promise. If we can't arrange all 3 intro calls by the end of week 5 of your program, each call we couldn't arrange is added to your balance as a returned request.
18.3 Your part. You agree to take part in the kick-off call and check-ins, give us the information we need, and attend the calls we arrange. If you miss an arranged call, it counts as used.
18.4 Cancelling Concierge. You can cancel within 7 days of paying, as long as your kick-off call hasn't happened, for a full refund. After the kick-off call, if you cancel we'll refund a fair amount for the parts of the program we haven't delivered.
18.5 Places. Each Concierge program has a limited number of places. When you buy Concierge, you're on the list for the program starting on 1 November 2026, and we'll confirm your place by email. If we can't offer you a place in that program, we'll tell you and refund $329.01 by 8 November 2026. That's the $499 less the founding price of a 1-year plan ($169.99): you keep your 12 months of platform access with 5 requests a month, and the rest of Concierge ends. This doesn't affect your right to cancel under clause 18.4.
19. What you tell Referrers
Your profile, CV and request answers must be truthful. Referrers rely on them to decide whether to meet you and, if they choose, whether to refer you.
Part C — Referrers (insiders)
20. Who can be a Referrer
20.1 You must be a current employee of the company you list, and verify your work email address with us. We take your company from your work email domain.
20.2 If you leave that company, you must close your openings and update your account straight away.
21. Listing openings
21.1 Founding insiders list for free. If you create your insider account by 11:59pm on 31 October 2026 (Sydney time), you're a founding insider and listing your openings costs $0. If we ever want to change this for you, we'll give you at least 30 days' notice by email, and you can stop listing before the change takes effect.
21.1B Insiders who join from 1 November 2026. Listing costs $1.99 a month and covers all your openings (up to 5). We charge it when you list your first opening, and it renews monthly until you cancel, which you can do any time in your account; your openings stay listed until the end of the month you've paid for. If a payment fails, your openings are hidden until it succeeds.
21.1A Card on file. When you list your first opening, you save a card with Pinch Payments. We don't charge it when you save it. You authorise us to charge it only for a no-show fee under clause 24 and, if clause 21.1B applies to you, the monthly listing fee. You can update your card at any time, and if you close your account we remove it.
21.2 Who sees your openings. Anyone visiting the Platform can see your openings, including your company, team and role. Your name, photo and LinkedIn are shown only to a job seeker whose request you accept.
21.2A Your openings must be accurate. You can list an advertised role or a team that's hiring soon ("hidden role"), but you must not say a role exists when you know it doesn't.
21.3 You set how many requests you'll receive each week, and you can pause, mark as full or close an opening at any time.
22. Your responsibilities to your employer
22.1 You're responsible for following your employer's policies, including its employee referral program rules, confidentiality obligations, conflict of interest rules and social media policies. If your employer doesn't allow you to take part, don't list.
22.2 You must not share information that's confidential to your employer.
22.3 Whether you refer anyone, and any referral bonus you receive, is entirely between you and your employer. We never pay Referrers, and nothing on the Platform is an offer of payment for a referral.
22.4 You must never ask for or accept any payment, gift or benefit from a Seeker.
23. Reviewing requests and calls
23.1 You decide which requests to accept or decline. Please respond promptly. If a request isn't booked within 15 business days, it expires.
23.2 You must make your decisions without unlawful discrimination (for example on the basis of race, sex, age, disability, religion, sexual orientation or other protected attributes under anti-discrimination laws).
23.3 When you accept, the Seeker sees your name, photo and LinkedIn, and can book a time through your scheduling link. Keep your availability up to date.
23.4 Treat Seekers' CVs and personal information as confidential. Use them only to decide on the request, prepare for the call and, if you choose, make a referral through your employer's process. Don't keep or share them for any other purpose.
24. No-shows
24.1 If you miss a booked call without rescheduling at least 24 hours before, and our team confirms it after reviewing what both of you tell us, the Seeker gets their request back.
24.2 No-show fee. For each confirmed no-show we charge a $20 fee to the card you saved under clause 21.1A. We only charge it after our review, we'll tell you before charging, and you can reply with anything we should consider (for example an emergency). Prices are in AUD; we're not registered for GST, so no GST is charged.
24.3 If you miss booked calls more than once, we may pause your account.
